In Resolution 174(II)(1947), the UN General Assembly established the International Law Commission (ILC) with the aim of undertaking studies ‘to encourage the progressive development of international law and its codification’. The ILC has been responsible for developing draft Conventions in many areas of international law. For instance, its 1966 draft Convention on the Law of Treaties formed the basis of the Vienna Convention on the Law of Treaties (1969). Further, it is becoming increasingly common to view certain multilateral treaties as ‘law-making’ instruments (see Chapter 2).

They require students to explain the means by which CIL is created and how it can be changed.
